Given the litigious nature of our society, achieving one’s personal goals and business objectives often requires the intervention of an attorney. For example, it is estimated that, last year alone, revenues related to the delivery of legal services in this country exceeded $125 billion. However, for many people and businesses, the process of finding the right attorney to handle a particular matter is one fraught with uncertainty and, in many cases, a significant degree of foreboding and fear. The result is often a mismatching of the client with the attorney. This can only result in dissatisfaction with the legal profession over the longer haul.

The Difficulty in Locating the Right Attorney

Individuals and small businesses have limited resources. While the traditional methods of finding an attorney might seem to be appropriate (i.e., word-of-mouth, yellow pages ads, online directories, bar association referral services, etc.), there are significant flaws associated with each approach. For example:

Word-of-Mouth:
-- results in a relatively small pool of attorneys from which to choose, with the attendant risk that none of them may have the necessary expertise to perform the work for which the client needs them
Yellow page ads/online directories:
-- only those attorneys who have the sophistication and financial capability to either (i) pay for the ad, or (ii) have their computer service professionals arrange for priority listing in search engines, will appear listed in either of these media. In addition, neither medium provides an objective way for the consumer or business owner/manager to assess and make a factually-based determination about the relative merits and capabilities of the listed firms.
Bar association referral services:
-- because many of these services refer attorneys on a rotational basis, the client ends up playing a kind of legal “Russian Roulette”, with all of its inherent dangers and shortcomings.

The Difficulty in Finding Good Clients

Most attorneys learn little, if anything, about marketing themselves while attending law school. And those who do learn how to do this often find themselves resorting to slick “Madison Avenue”-type approaches to drumming up business. In addition, it is particularly hard for:

  • -- older, experienced non-“rainmaking” law firm partners
  • -- senior law firm associates without a substantial “book” of portable business
  • -- older, but experienced in-house counsel who’ve been downsized or “rationalized” out of a job, and
  • -- part-time, contract and temporary attorneys
to find the clients who are both enjoyable to work with and reasonably respectful of the professional capabilities and talents of the attorneys with whom they work.

Truthful and non-deceptive advertising is both costly and subject to significant scrutiny by the bar associations (which have a vested interest in reducing or controlling competition and in the current fee structure). Consequently, attorneys must devote a substantial amount of time to networking (with its attendant costs), responding to “help wanted” ads or taking work either outside of the profession or inside, but at a compensation level which both demeans the significance of the work being performed as well as the lawyer or legal professional who is performing it.
